Defense Verdict Related to Cancer Care

Plaintiff, widow of the patient, sued our client for $582,140 for negligence relating to a staph infection from a PICC line placed during the patient’s treatment for aplastic anemia, alleging that it had progressed to the extent it was no longer effectively treatable, causing the patient to die.

Co-defendant was dismissed from the case on Sept 4 (trial day 4).  The case against our client went to the jury on Sept 9 and after a one-hour deliberation, the jury returned an 11-1 verdict in favor of our client.

Oregon Association of Defense Counsel President and Hart Wagner trial attorney Gordon Welborn and Hart Wagner associate Michael Jacobs both have articles in the OADC 2015 Issue 2. Mr. Welborn wrote the article “Investment in Justice” regarding judicial salaries in Oregon and Mr. Jacobs wrote an article titled, “They Will Ask, Do Not Tell: Avoiding Waiver of Attorney-Client Privilege.”

Unanimous Defense Verdict

Congratulations to Rod Norton and Dawn Garrison! After 9 days of trial in a $3.8 million medical malpractice case, the jury came back with a unanimous defense verdict for our clients.

Defense Verdict in Auto Accident

Joe Traylor received a quick delivered defense verdict today in Clark County, WA after 20 minutes of jury deliberations. Plaintiff was claiming $8400 of chiropractic care and $35,000 in non-economic damages. The jury found the 8-10 mph automobile accident was incapable of causing injury.

12-0 for the Defense!

After a five-day trial, Karen O’Kasey has won a medical negligence and battery case in Multnomah County.  Plaintiff alleged that during a water soluble barium enema procedure performed by the defendant, the catheter perforated her colon, resulting in bleeding, and a delay in the reversal of her ileostomy.  Plaintiff was seeking $800,000 in non-economic damages and over $200,000 in economic damages.  After a short deliberation, jury came back 12-0 for the defense!

Case Abandoned by Plaintiff Mid-Trial

Case abandoned and dismissed with prejudice by plaintiff mid-trial in $40 million birth injury claim in Marion County Circuit Court alleging failure to perform a timely cesarean section and perform appropriate neonatal resuscitation resulting in cerebral palsy.
